Hey all,
I'm looking for some advise, a family member has been refused a home assessment for ESA despite them always being offered for PIP assessments.
Their doctors are refusing to do a letter, I've had a look online ans see posts suggesting writing and stating EA10 regulations but I have been unable to find a guide or template and have no idea how to structure such a letter or even what to put in it.
The family member has Multiple Sclerosis, which results in them having periods of being housebound though they are also sometimes able to attend medical appointments. They also have diagnosed PTSD and chronic sever anxiety.
Any help greatly appreciated.

We don't have a template letter for this but it's not too complicated to write yourself, the key thing is to say that the home assessment would be a "reasonable adjustment under the Equality Act" but you will still need to explain why the person cannot attend at their offices at the date and time required.

Yes, that's the issue we are having, their GP practice has stated that as they attend the surgery they are unable to write a letter of support.
They are not housebound a 100% of the time but we can not predict how they will be on any given day, if the appointment falls on a day they are unable to leave the house then they are going to run into trouble, maybe they will allow them to rearrange but then what if it again falls on a day they can not leave the home.
Atos have never argued a home assessment, well they have but after complaining and reviewing medical evidence they have always granted a home visit, PIP is not on a 10 year award but the ESA assessors just won't move.

They will only be allowed to rearrange the appointment once.
Would the GP be willing to certify in writing on the day of the assessment that they are unable to attend?

Would something along the lines of below be ok?
Formal EA10 request.
We write in regards to a request which was made in the ESA50 form for XXXXXXXXX – national isurance number XXXXXXXX.
A home visit has been denied and so we would like to progress to a formal request for reasonable adjustment under the Equality Act which XXXXXX is covered by.

You need to explain in the letter, it does not have to be in detail, why they could not attend at their offices, I realise you have done this in the ESA50 but you are relying on the person reading the letter to go and read this information. You also need to consider, if you need to escalate the situation to your MP; as an example, that they will not have access to your form.
