Hi Gordon , originally when I was on dla I had full mobility , indefinite ,then when the transition of transfer to P.I.P. occurred I lost the mobility full. down to standard , I was then 66 now im told at 69 I cant apply for or get enhanced ((full mobility) because of my age ????? so could you let me know what the guide lines are now regarding age barring , as a friend has been on D.L.A, on full mobility granted for life , and now at 77 hes still on DLA & on full mobility , seems a bit funny as to why he hasn't nbeen transferred to p.i.p. , ??? how does that work , to me that is under the human rights act they are not taking my disabilities serious ??? I would be most obliged for your opinions on this subject , many thanks Gordon & kind regards Mozz

The rules for PIP are the same as they are for DLA. Once a claimant reaches 65 or State Retirement Age, whichever is the later then they cannot receive a Mobility award if one is not already in place or an increased award, even if they meet the criteria for one.
The legislation that controls the transfer of DLA claimants to PIP suspends this rule so your friend will be able to receive a Mobility award if they qualify for one.
DLA claimants are being chosen at random so your friend could receive an invitation to morrow or next year.

Hi Gordon & many thanks for your reply , regarding your reply to the 1st part i.e, retirememt age "65" does this mean it wont succeed at an tribunal court ????? . cheers mozz

If you were over SRA when the latest Decision was made then an appeal will not be successful, with the possible exception of your showing that you clearly met the criteria before you reached SRA but this argument may well be defeated if you did not report the Change to the DWP.

Hi Mozz
If you were in receipt of DLA and had an indefinate or life award and you were over 65 on the 08/04/2013 then you will not be re-assessed you will stay as you are unless your health improves.
For those over 65 on the 08/04/2013 if your DLA award ends you can make a renewal claim, or a link claim within one year of your previous award ending. If you leave it longer than one year you must claim Attendance Allowance.
For those in receipt of DLA born after 01/04/1948, you will be re-assessed at some stage.
As Gordon has stated previously if you are over 65 and renew your DLA or PIP the mobility component cannot increase even though you may be less mobile, which is why if you have mobility issues you may want to think about contacting DWP about a change of circumstances before you reach the age of 65, but you do run the risk of loosing what you already have.
Note: Northern Ireland is over 65 on 20/06/2016
