I have assisted two friends with appeals to Tribunals (one won, one lost). In both cases the judgment document I received was very brief with a decision but no reasoning.
When Upper Tribunals consider appeals against First Tier Tribunals they give their reasons and refer comprehensively to the reasons given by the First tier. Can one ask to be given the First Tier reasoned judgment in full before an appeal as I believe they are not published online as Upper Tribunal decisions are.
The claimant can ask the Judge in charge of their hearing to produce a Statement of Reasons after the hearing but I would only recommend that this be done if the claimant has an intention of appealing to the Upper Tier.
The SoR will also be sent to the DWP which introduces the risk of them appealing the Decision where they may not have done so otherwise.
First Tier Decisions carry no weight beyond that appeal so the SoR cannot be used as a precedent for another claimants appeal,
