MRN, Consultation Report and contradictions was created by Paul
Hello
I have Bipolar and have a couple of questions having received my Consultation report PA4
When submitting my Mandatory Reconsideration details do I say that I’ve seen the report?
Secondly, the history at the beginning sounds fairly ok and accurate but doesn’t match the the Health Professional’s opinions. Not only that but they have copy and pasted some of the statements which don’t necessarily relate to activity. Is this common?
If I can mention that I’ve seen the report is it worth pointing out some of this?
When they describe what people look like and talk what do people say to this. My definition of how I look and sound when I’m well is very different to theirs. I find this area very difficult. Unless you have just climbed out of a gutter how do they expect you to look?

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Paul
1. Yes, you should say that you've seen the report because it's this you are challenging.
2. It is common for the assessors to copy and past (and not always accurately so). You can say where it's wrong, but the most important thing is to focus on where you didn't score points and where you think you should.
3. In terms of arguing what you look like - remember that it is only an opinion. If they say you looked well, say that the assessor does not know you and describe what you were feeling and any symptoms you were expressing. If they said you were well dressed, point out that your appearance is no indication of your mental health and that often the worse people with mental health are the greater effort they make to cover it up, particularly with strangers.

Hello BIS
Thanks for all this, it’s very helpful.
I’ve got one more question, for the moment.
When I look through all the sample stuff the sample details that are referred to for the MRN seem to be for appeals. Is that still the one I should be using?

Paul
Yes, your arguments for an award are not significantly different from an MR to an appeal you just might have more time for an appeal to compile them.
