I have recently been refused PIP after being on indefinite DLA low mobility and care for past 12 years. I was forced to put in change of circumstances when I moved ten months ago, and completed a PIP form as requested. However, I scored 0 on both counts and not sure whether I should go for mandatory reconsideration. I received my decision on 26th November and have until 26th December to put in form for reconsideration. This is a very tight deadline when I have no support. Also, I am now 67 years of age and wonder why I should be applying for PIP from DLA. Should I have applied for Attendance Allowance instead?The DWP wrote and asked me to apply for PIP because DLA was finishing.

Everyone who was born before 01/04/1948 and in receipt of DLA will stay on DLA if you have an indefinite award, for everyone else you will be reassessed.

The difference between DLA and AA apart from the age, is that there is no mobility component with AA. As you are of pension age the mobility component will not increase but the care component or daily living component as it is called under PIP, can increase to the enhanced level.

Take a look at our guides www.benefitsandwork.co.uk/help-for-claimants/pip, we have a 33 page guide to mandatory reconsideration. Due to time limits you may want to, once you have read our guides, phone DWP to put in a MR over the phone and follow up the request in writing.

Taking into account your DLA records - you need to make sure that whatever is included is relevant to the PIP criteria and you need to say why it is. Again the way DLA was awarded is different from how PIP is.

PIP was engineered to be a more difficult to award than DLA, many DLA claimants will receive vastly reduced awards or even no award at all on transfer.

DLA looks at generic care needs in regard to bodily functions, PIP looks at the claimants specific ability to carry out an activity such as eating. DLA was awarded because the claimant needed an amount of care (in time) during the day, the night of both, to help them with that bodily function. PIP looks at the claimant's ability to complete specific tasks within the activity and is points-based, these are clearly defined and it is easy not to score points because the claimant has not shown that they meet those specific criteria.

DLA treated the use of aids as a reason to reduce the amount of care needed, PIP treats aids as an indication of disability and in general they score extra points.

DLA's care need was reasonably generic, PIP treats prompting, assistance and supervision as different activities and as a result, they can score different points.

DLA required that the care was required for the majority of the time, for PIP it is the majority of days.

For PIP activities must be completed reliably, this means

• Safely – in a fashion that is unlikely to cause harm to themselves or to another person.
• To a necessary and appropriate standard – given the nature of the activity.
• Repeatedly – as often as is reasonably required.
• In a timely manner – in a reasonable time period.

Although DLA considers these terms, they are poorly defined as they are implemented through Case Law rather than being defined in the legislation as they are for PIP.

Referring to any more recent evidence you have is more useful.

I am hoping to have mandatory reconsideration but it is all so complicated and I am running out of time. Now the 17th and I need to return by the 24th. I feel worried about telephoning because of the beware information on this site and also, need to consider how to challenge. I have downloaded the information but need to read the decision letter again and consider what can be challenged. It seems that you have to be really well to complete these forms. It's like jumping through hoops and performing like a circus animal. Will be in touch when Iv'e sent off my letter. Thank you for all your information Gary. It was very helpful. Maximillian.
