hi I suffer severe mental illness, I have been on various sections twice section 3. I get pip both higher rates. I fear being forced into environments where I get uncomfortable and it could end up in a scene where myself or others could get hurt or where police could be involved leading to prison etc. the benefits I get enable me to control the areas where I go and avoid people who I feel threatened by. is there any way to put the dwp on notice that I intend to take legal action if im taken off benefits.Then I have to be in situations and areas where im vulnerable and cant walk away?
The simple answer is no! You receive your benefits because you meet the legally defined criteria to do so, if you continue to meet that criteria then your PIP should be re-awarded, you need to concentrate on showing that you do but if for any reason you do not receive the same award then there is a legal process you can follow to challenge the Decision.
