Dear Advisers,

I had my second UC work capability assessment on Saturday at the centre in Bristol. Using your guides I hoped to score 15 points under moving around, 6 for sitting and 6 for my bowel problems. This would have been an increase in points under moving around as my walking is becoming more and more difficult and painful.

The assessor ( another one of their charming young ladies ) just launched into questions about my bowel problems and after 10 minutes just said your assessment is over and started gathering her things. When I asked about the rest of the questions and started to tell her about my mobility questions she said she had all the information she needed and I would be placed in the support group because of my bowel problems. When I pointed out that this was a UC assessment and not ESA she got stroppy. She refused to listen when I asked her about Limited Capacity for work and work related activity.

I was relieved that the assessment was over so quickly but was just left feeling that I had been tricked somehow. I wanted it to be recorded somewhere what I had to say about my mobility and wanted to score the points under this descriptor rather than my bowel problems, which could improve if the medication I have to take is changed. The arthritis in my feet and back will never improve and gets worse and worse as time goes on, so I now feel that I want to appeal to get all this recorded under all the descriptors where I should score points rather than just one.

Please advise me

You can't really do anything until a Decision is made then you can ask for a copy of the assessment report to see how it was made.

In case you are not aware, ESA is not a walking test, it is a Mobility test! In addition to your walking, it considers your ability to self-propel a manual wheelchair over the same distances, you do not need to be using a wheelchair or even to own one for it to be considered. SO even if you can show your walking is restricted unless you can also show that you cannot self-propel the wheelchair you will still not score points.

If you are placed in the SG then you really have no right of appeal to have another Descriptor considered, it's about the award not how it was awarded.

I will wait until I get the assessment report and get back to you if I need your advice some more. I did not know about the wheelchair issue, so perhaps I should count myself lucky.

This is a UC claim, so the next fight of course will be proving LCWRA as well as LCW. If not I will lose money compared ( like for like) with my ESA brothers in the support group.
