Hi jim555
Never send in original documents, if you are applying for either a MR or an appeal, always send in photo copies of any documents. When documents are received by the DWP, they are scanned onto their system. DWP will not send you back your original documents.
The only time you have to send in original documents is when DWP want to see proof of any savings or pensions when applying for IR ESA SDP or PC, they will send back your original documents, but always take a copy of the documents before sending in original docs and either send documents by recorded delivery or get proof of posting.

Thanks Gary. So will DWP get to copy and hold on file all documents I send in to the appeal people? Do the appeal people destroy all the documentation once they reach a decision or just pass it all over to DWP?

Also what happens if you submit further submissions after receiving DWP submissions? Do the appeal people have an obligation to provide DWP with a copy of your further submissions or not?
Also should the DWP decide to agree with your appeal, before the tribunal make a decision.. would the only method this might happen be via a telephone call to the claimant? Do they never send you a new decision later with a revised decision/ award in the post? (If they can't make contact via telephone... Is it opportunity missed?)

Hi jim555
Whenever you send any documents to HMCTS, they will send a copy of the additional supporting evidence to DWP and also to yourself.
I am not sure what they do to the appeal documents after a tribunal hearing, we keep any documents for 6 years then destroy them, if that is of any use.

Hi jim555
The answer is yes, you can submit further documents up to a week before the hearing, you can even take additional documents to the tribunal on the day. Whenever you send additional documents to HMCTS they will send a copy to DWP and also to you. The documents they send you will have page numbers written on them so if the bundle of documents from DWP goes up to 101, if you send in 3 additional supporting documents then they will be numbered 102, 103, 104.
At any time DWP can review your application and can inform you by phone or post, you might also get a letter from HMCTS. I received a letter last week from DWP about an appeal we applied for in November 2019, we went from zero points to enhanced for DL and standard for mobility, we were looking to get standard for both components.
If you are unhappy with the revised award then you can appeal that decision, but you may loose what you have been offered. I have appealed decisions that we did not believe was correct and won but you always have to be aware that you could loose.
