PIP assessment - 2 points! was created by wing
I have only been awarded 2 points and therefore no PIP.
Have a short time to send in Mandatory Reconsideration. Should I ring dwp first and ask for one and if I do will they question me for the reasons or can I say I will be sending them the form with the reasons?
Either way, I will need your help to explain why I should have been awarded more points.. I have read through your guides but need a bit of help explaining why I meet the descriptors.

Hi Wing
The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.
www.benefitsandwork.co.uk/help-for-claimants/pip
You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.
Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;
"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"
than their opinions
"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.
When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.

Replied by wing on topic PIP assessment - 2 points!
Hi
I have the HP assessment report. They have only given me 2 points.
Which the DM seems to have agreed with and not awarded me any point for the other tasks I have difficulties with.
First Preparing and cooking a simple meal. No points.
The HP ticked I can do this task.
I ticked yes in my PIP form that I need help from another person and gave extra information. That I am unable to peel and chop vegetables or cut up meat because my shoulder and arm get very painful and it takes a long time and I’m in danger of cutting myself. I also have bowel urgency (Crohns) and I may have to go to the toilet at any time - 2 or 3 times during cooking which makes it hard for me to cook safely leaving pots on to burn or boil over. I also stated this exhausts me and I have to rest and I am unable to continue without assistance.
The HP has stated in their assessment justification for descriptor choice
that reported difficulties are inconsistent with findings at assessment.
That I am not under any specialist care and takes no treatment or medication for diagnosed Crohn’s disease.
I explained why I do not take the medications any more in the pip form and at the assesmment.
One was giving me side effects and the other I was advised to stop by the consultant when I got cancer,
HP also goes on to say I have no input or treatment for painful right shoulder and neck.
I explained that I take pain killers. Their is no more treatment and this is a result of surgery when I had cancer.
The HP has stated the MSO shows slight power reduction in right arm and hand grip and I declined right shoulder movements.
Right hand grip is further demonstrated in the IO where it shows she is able to grip a pen and sign her name with right hand.
They did not ask if I was in any pain, which I was, in doing this and I stated I would try and sign my name but did it very slowly and had to hold my right hand hand with my left. I stated that I was unable to write on the Pip form and asked my friend to fill it in with my words and I stated this on the form and at assessment.
The HP has used the same reasons for all the tasks that they say I can do.
Sorry, this is so long but there is a lot of things that have not been recorded by the HP accurately.
Can you give me some advice as to how to state my difficulties on my MR please.

Hi Wing
Did you submit any medical evidence with your claim? If you did then in your reply you need to contradict what the assessor has said. Do you have any evidence of the advice that the Consultant gave you or was this just an oral instruction? I wonder whether the consultant ever advised that in a letter to your GP - they certainly should have done. You could access your GP records and use whatever is relevant in your MR. I think you have already explained what you need to say, from what you have written below. If you need help to prepare meals - do you actually get it? If so, can the person who helps you write a supporting statement?
If you are exhausted from your Crohn's do you ever miss out on meals? If you do you should say so and how often.

Hi Bis
Thanks for your quick reply.
I gave a copy of my medical history that the GP surgery gave me to the HP at the assessment. There is no mention of this on the HP’s report? I I asked at the surgery if the GP could write a letter confirming my medical conditions but was told by the receptionist that there was a charge of £25 and it would take about 3 weeks. She very kindly printed out two copies of my medical history without charge.

My friend is willing to write a letter of support stating what help they give me and for what tasks.
I don’t know if my consultant (Gastroenterologists) ever wrote to my GP stating that they advised not to take the medicine. They told me orally and I had my friend with me who can confirm this. We were worried that the medication had somehow brought on the cancer as it was an immunosuppressant and he showed us a very old report (10 years old) that they had found a few cases and then he advised me to stop taking it.
