Hi,

I have submitted a PIP application which was awarded 0 points, I then requested a mandatory reconsideration which has also been awarded 0 points, there were numerous errors made by ATOS including some outright lies which I pointed out in the mandatory reconsideration request. I also included further information on my condition.

The response has a line which states that 'I have no reason to doubt the Health Professional's findings and cannot ignore the information contained in their report' (the report essentially states I have no problems). The 0 points at mandatory reconsideration essentially refers to the ATOS report to justify the award.

At this point I am completing an online appeal. The appeal form asks for reasons for appeal. My questions are:

Is this my only opportunity to give reasons for appeal?
Does the tribunal have access to the mandatory reconsideration letter?

Hi Bubbles

If you're putting in an appeal, it is best to give your reasons for it now - after all you want the tribunal services to accept it. However, you are allowed to submit additional evidence at a later date if necessary. You can read the details in our appeals guide.

How they reached their decision including what their response was to your mandatory reconsideration should be part of the bundle that the DWP will send once the appeal has been agreed.

The Tribunal will see the whole bundle of documents that the DWP will send out in regards to your appeal, when you get the bundle, go through it and check all your supporting documents are there, if you want to add additional supporting documents then send it to HMCTS not DWP, HMCTS will send copies of any additional supporting documents to the DWP and to you. The additional supporting documents will have bundle page numbers written on them.

Hi,

In my mandatory reconsideration letter I outlined all of the errors with the medical assessment and also detailed how my condition actually affects me vs the MP statements (20 pages in total). Is it ok to copy and paste this all into the appeal submission?

I now have supporting evidence from my GP so will send that in along with photo evidence of my condition

The tribunal should get a copy of your Mandatory Reconsideration, but there's no harm in repeating the issues that you have already raised and not having to type it all from scratch.
