assessor report was created by Nina
I have just received the assessor's report. she gave my niece only two points. She omitted most of the things my niece said. eg she finds it difficult to do the ticked activity when her skin is painful. My niece also told her on the day that her skin was not sore.
Her reasons were that she showed full flexion and power in lower and upper limbs, and back. IO shows she was able to sit and stand unaided.
That was not the reason she applied for PIP.
She totally ignored the help she needs, which is needing assistance with her skin in places she can not reach and see. My niece told her about the therapy, she asked her who recommended it and my niece said the doctor. She did not mention the therapy at all in the Activity.
If I want to write to the DM, who should the letter be addressed to? Or should I say to whom it may concern? Also what address should I use?
Thanks

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Nina
You can address the letter to the 'Decision Maker' and send it to the address on the original claim letter.
You could also try ringing first and ask if you could speak to the decision-maker and make your points over the phone and then confirm any conversation you held in writing afterward. (You may or may not be put through).

Hi Nina. Was the therapy prescribed by the doctor or just recommended? During my PIP assessment, my assessor told me she was only interested in prescribed medications and therapy .

I called DWP and I was told I could not speak to a DM because no PiP decision had been made and it will take around 6 weeks to make the pip decision.

Hi Nina
There is a small window for you to write to the Decision Maker but you will need to be quick.
Understand that the assessor is offering an opinion when they say that you can do the PIP activities, tackling these head-on is unlikely to be successful, you need to show that the basis of that opinion is founded on incorrect information, so try and refer to your evidence to undermine what they have said.
Also, try and stick to issues that lead to your scoring points, I often hear members referring to the assessors spelling, as an example, whilst it may show a lack of professionalism, raising it as an issue isn't going to help you get an award.
Make sure that you understand the criteria that you are being assessed against you can put the best case forward that is possible but you won't score points if you do not meet the PIP Descriptors.
Lastly, make sure that your letter makes it clear that you are not requesting a Mandatory Reconsideration but you reserve the right to do so once a Decision has been made.

Thanks Becky.
The therapy was recommended by a doctor. She has been doing it for 4 years now. According to the DWP, Therapy means therapy to be undertaken at home which is prescribed or recommended by a doctor.
