Assessment report - a load of rubbish!

Hello
I’ve just received my assessment report from 28th February. It doesn’t bear any resemblance to the answers to the questions at all! I’m absolutely incensed! It’s like it’s written about a different person!

What do I do now?

Hi Lucy

I am sorry this has happened to you.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

www.benefitsandwork.co.uk/help-for-claimants/pip

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.

Thank you so much for your reply.
I have the report before the decision. Do I need to wait for the decision or should I call and ask for a note to be on my file stating I do not agree with the content of the report?

Hi Lucy

You have a small window in which you can write to the decision maker challenging the report. Make sure you concentrate on the parts where you think you didn't score points and you should have done. You can post it to the address on your original claim. I know some members have actually tried to ring and speak to someone at the DWP or requested a call-back about their report. If you try to ring, always make sure that you write straight afterwards confirming the conversation and any outcome from your call.

Thanks for your reply.
I use the relay service to contact DWP due to my hearing loss and I contacted them yesterday afternoon, asking for a note to be placed on my file stating I have concerns over inaccuracies and the fact my disability is even incorrect. She said she would email the DM and the fact I had sent lots of evidence in would be enough for them to make a decision. So I’m gearing up for MR and getting all the paperwork in line for that.
