ESA paper based decision was created by Claire53
Hello all , I completed my ESA claim form, back in April 2019. I had a Tribunal for my PIP claim medical was Aug 2018 Tribunal date had not been set until after i completed my ESA claim form, i sent along with claim, Drs Letter, any information from other health professionals for different aspects of my Health Problems. Also sent a long report from my Therapist where she gave her professional opinion regarding my long enduring Mental Health Problems. I won Tribunal which was finally heard almost a year after my Medical for PIP. I was awarded higher rate of both care and mobility. within a few weeks of Tribunal , my Amount Increased, i had not informed them of Tribunal result or any changes ESA increased WRAG,. I was sent a date to attend a Medical for ESA but i had asked for a home visit as i had previously due to not being able to travel any great distance from my home even with support.
So had a good result for PIP, and i called Jobseekers re my ESA claim as it had been a longtime since i sent form back , i was asked by person i spoke too,in September 2019, to send any further information to support my claim,.. I called the Number when i received letter to go to face to face, and i told them i could not attend a F2F due to my difficulties and i had asked for home visit, was told that DWP said i did not meet criteria for home visit. I was told they would sent me a new date for a place closer to home, but still too far for me to get too. I was sent letter fro new location and date, then few days later i was send another letter stating i did not have to attend as they would make a paper based assessment. I finally received outcome of this by letter i was told i had been moved into SG. But decision was based on the extra information i had been asked to send 19th September 2019 , copy of Tribunal for PIP, a covering letter stating i wanted this to be added to my existing claim, also a letter from Hospital regarding a admission i had for a chest infection, and a copy of letter requesting me to go to Respiratory Clinic for test to see if i now had developed COPD. I rang Jobseekers and asked why it was only back dated to September 2019, and was told as the extra information was what the decision was based on, so i am not entitled to it being back dated to when i Originally completed ESA form April 2019, i also said i was asked to send in this extra information , i had stated in my claim i suffer with Asthma , i did not know when completing form i would win Tribunal, nor could i tell them about admission to Hospital as that had not happened either. or send them results of my apt , i can still not tell them outcome of Respiratory Clinic Tests as they have still not been sent back to my GP. I feel decision should have been made on my Completed form not additional information, I called but the insisted they would not back date it further than 19th September 2019 , when i said my ESA increased after Tribunal for PIP she told me it would not have as they have nothing to do with one and other yet i have it in writing they increased it and bank statement? and i never contacted them re outcome of appeal so how did they know to increase payment? then she claimed they had back dated that increase to Oct 2018 if they are linked surely that should have been to date i completed PIP forms earlier in 2018 before Medical. Has anyone had any experience similar to this at all?
