Hiya
I first applied for pip 9th August. I had my home assessment cancelled twice then had my assessment at a centre on 3rd feb (nearly 6 weeks ago now) 2 days after my assessment I had a text saying the dwp had received my report and I would hear from them within 6 weeks. I phoned and asked for a copy of the report, the man told me that no one is allowed a copy he said he would speak to his supervisor after the weekend and get back to me. He phoned back and said I wasn't allowed a copy. It seems from this forum and other online sites that everyone has been able to get a copy. He was quite rude and abrupt with me saying we aren't going to tamper with it if that's what you think etc. He also told me it would be at least 8-10 weeks for a decision. Just wanted some advice on how other people got their copies and why they won't give me a copy of mine until I have received decision?

No the person from the DWP is wrong, hopefully you got their name, this is not acceptable and you should make a complaint to the DWP about what happened.

I would try again and contact the DWP, hopefully this time you get someone who knows what they are talking about, what you should have done was asked to be put through to a manager.
Once you get a copy of the report, there is a small window for you to write to the Decision Maker to correct any inaccuracies, but you will need to be quick.
Understand that the assessor is offering an opinion when they say that you can do the PIP activities, tackling these head-on is unlikely to be successful, you need to show that the basis of that opinion is founded on incorrect information, so try and refer to your evidence to undermine what they have said.
Also, try and stick to issues that lead to your scoring points, I often hear members referring to the assessors spelling, as an example, whilst it may show a lack of professionalism, raising it as an issue isn't going to help you get an award.
Make sure that you understand the criteria that you are being assessed against you can put the best case forward that is possible but you won't score points if you do not meet the PIP Descriptors.
Lastly, make sure that your letter makes it clear that you are not requesting a Mandatory Reconsideration but you reserve the right to do so once a Decision has been made.

Hi Laura
You are perfectly entitled to request and receive your report....I sometimes think that there are so many loopholes and much backtracking by DWP that many of their employees are not aware of claimants entitlements and of course there are the ones who simply use their positions to intimidate.

I did ask to speak to his manager he said he wasn't there so I asked to speak to whoever was above him again he told me there was no one til the Monday (this was mid Friday afternoon) he said he would speak to his boss and get back to be about 5pm on the Monday which he did but said the same. He really didn't want me to have a copy and I don't understand why. He said it's because thats not the decision and although assessor may report I should get pip dwp may not agree and go with her decision. I understand that and understand the report is not the decision. He kept asking me where I had heard that I could get a copy because it was wrong.i didn't really know what to say. I will get my partner to ring again, I get so anxious just phoning them because I've had a few bad experiences now

Thanks Becky, I did think this was the case but really just couldn't get anywhere with him on the phone. Will get my partner to try again. It's been 6 weeks now and not heard anything but guessing the wait will be even longer now with corona virus etc

Like Gary, I'm appalled. I don't know whether your partner is able to ring on your behalf, but I should try again because what you have been told is nothing but a lie.
Obviously you don't want to antagonise anyone so I wouldn't actually use that word, however, I would tell them that you know categorically that what you have been told is not accurate and that you are entitled to see a copy of the report once it has been loaded onto the system.
Your partner should say the fact they are deliberately withholding a copy leads you to believe that something may not be correct with the report. As they are refusing to tell you what that maybe, you are going to put in an official complaint, asking why you are being discriminated against.
If the person your partner speaks to does not give a positive response, you once again ask to speak to a manager - and see what they say. Make sure that your partner documents the exact conversation. If it is still a negative conversation, if you have the energy to, you should immediately put in a formal complaint.
I promise we are not giving you the wrong advice here. For ESA you are not allowed the assessment report until the decision has been made, but for PIP you are, and many, many people on this forum and others have had theirs within a few days of their assessment.
