Hi all.
I am moving home, separating from partner. I am in receipt of ESA legacy support group, partner/ ex partner is added to current claim. She is also my carer and will no longer be. I plan on updating my address, notifying ESA she is no longer my carer and to also remove her from my ESA claim. My question is, my house move is still within the same local council. Am I exempt from being moved onto universal credits and therefore still able to get my housing benefit paid directly to my landlord?

Am also worried for my ex partner, going forward when I make the above changes. When she ends my carers allowance claim, can she switch it to my disabled daughter instead of me? Would this help protect her with her impending universal credit transition? She will get housing benefit paid and currently gets extra tax credits for disabled daughter... Is she better off claiming carers for disabled daughter of leaving the extra elements in place for tax credits for the universal credit move? Will she be on JSA? Youngest daughter 3 years old, a disabled daughter high rate DLA care. Eligible for carers for her but not claiming at present. Any advice most welcome!!

We normally cannot give the level of reply that you are asking for but given the difficulties that members are having getting additional support I will do my best but I will need more info for you.

You mention Carers Allowance but not an enabling benefit, so do you have an award of DLA MRC or HRC or a PIP Daily Living award?

There appears to be an existing Housing Benefit claim, in whose name is the claim?

Here are the issues; if you are not the HB claimant then you will need to make a new claim, this means a UC claim unless you are entitled to the Severe Disability Premium, you don't qualify for this at the moment but may once you are living apart but need a DLA or PIP award.

If you can provide the info required I may be able to give you a way forward.

Morning Gordon. Thank you for your reply, difficult times all round! Appreciated. Sorry, so I do get PIP, enhanced daily living and standard mobility. As for the current housing benefit claim if it can only be under one name I guess it is my ex partners. If it can be joint then I would guess we would both be listed? I am also on the tax credits award and the council tax award..

Is it best to cancel this carers claim now then and request my SPD entitlement back? Although I definitely have pip enhanced daily living.. am I safe from universal credits? Therefore can get housing benefit paid directly to landlord as is currently happening?

Should I make my ex partner end her claim to carers allowance now, and request my SPD is added to my ESA claim? Do this now before I move address and update ESA with new address, remove ex partner from claim and continue on ESA legacy and get my Hb award without the threat of being moved onto universal credits. I am in receipt of enhanced rate PIP daily living and I am moving address within the same local authority. Thanks for your help !

I can confirm looking at the housing benefit award addressed to my ex partner but says on calculations you are receiving ESA income related. I am main claimant for ESA claim my partner is just added on.. is this good news for me moving out to a new property non my own and claiming Hb ok with sdp rather than forced into UC?
On the council tax award letter I am listed as liable as well as my ex partner.

In order to be eligible for the SD Premium you will need to be living alone and your wife will need to have closed her CA claim against your PIP award.

Once this happens, contact the DWP office dealing with your ESA claim and ask for the Premium to be put into payment, this will require you to complete an IS10 form, it should be possible to do this over the phone. The form asks about your living arrangements.

Once the Premium is in payment then you can make a claim for Housing Benefit, as you don't specifically know whether the current claim is in your name it would seem likely that it is your wife's but I would still check with your Local Authority.
