Hi, until recently i have been getting ESA support (cont.), PIP both parts at higher level, while my partner got state pension sadly he died of a heart heart suddenly on the 2nd April, i thought i was entitled to then claim the SDP, but when speaking to ESA they told me that it is only paid for earnings esa, and that i need to contact housing benefits and get them to make a adjust, and then they, the esa, will be able to place me on the earning esa and so paid the SDP,
so tried several times and finally got in touch with local council, they won't make any changes until esa tells them to, so now i am just going round in circles with no one helping lockdown while still sorting out my partners cremation etc.
so could someone please tell me how if possible, i can sort this mess out, and just what i am entitled to,

Hi emma

There are two sets of requirements for the Severe Disability Premium.

First, to be eligible for the Premium, you need to be receiving a qualifying benefit such as the PIP Daily award that you have just received (there are others) and you need to be living alone or considered to be living alone and no one must be receiving Carers Allowance against the qualifying benefit.

Secondly, to be entitled to payment of the Premium you need to be receiving an Income Related benefit such as ESA(IR), Income Support or Pension Credit but not Universal Credit.

If you meet the qualifying conditions then you should contact the DWP office dealing with your ESA claim and ask for the Premium to be put into payment, this will require you to complete an IS10 form, it should be possible to do this over the phone.

Hi and many thanks for that, at the moment i am getting PIP daily enhance, but i am also getting ESA contributions, so can i claim IS, or get my SEA changed to earnings?

when i spoke to ESA they seemed to think i should be able transfer but were not really clear, and i was not really up to talking to properly as had only lost my partner the day before,

Hi emma

ESA is an indefinite award with scheduled reassessment based on the Prognosis Date completed by the assessor in their report, so your existing ESA award continues in payment until a new Decision is made.

If you are receiving legacy ESA then you can asked to be financially assessed for Income Related ESA. ESA(IR) is dependant on your household income, your savings and assets. You can get ESA(IR) on top of your ESA(CB). See

You can put your information into one of the online benefit calculators to check eligibility.

Once you are in receipt of a means tested benefit then you can apply for premiums such as SDP and EDP.

Hi Gar, thanks for your reply and sorry to have taken so long to get back to you, been busy sorting out cremation etc details,
by legacy i am assuming that you mean having been moved from another benefit - if so then i was moved from SDA to ESA, 1 of the last to be transferred.
what is EDP,?
sorry lot on my mind at the moment

ESA is now considered to be a legacy benefit along with other benefits such as JSA and Income Support as the are now replaced by Universal Credit (for new claims).

EDP is the Enhanced Disability Premium which will appear as the "Disability Income Guarantee" on your ESA Entitlement letters.
