hi i applyed for esa an dreceived a letter to say that we can not pay you esa from such a date we canot pay you because you hav not paid or credited enough ni contributions.
then it follows that that you have used the tax yr 2018-2019 we may still credit you with ni contributions while claiming esa to continue to receive esa you may need to attend a work focused interview with a personal advisor.
to continue to receive esa you may need provide a medical certificate untill a work cabability assesment is carried out .
just been awarded high care and low mobility from dla middle care and high mobility but is currently apealing mandortory consideration .
could you explain this and would i need to attend a accesment or interview as i suffer agraphobia alongside outher medical illnesses.
currently is on universal credit as i didnt attend a medical due to beeing ill and canceled my claim and now missing out on disability pemiums .
can you please advise me would be much appreciated.

You are applying for New Style ESA, which is a Contribution Based benefit this means that you are only eligible to receive the benefit if you meet the associated Contribution Conditions which require you to have a minimum of 50 weeks of NI Contributions in both of the Tax Years 2017-18 and 2018-19, it sounds as if you do not have sufficient NICs in the latter TY.

You can receive NI Credits that count towards a full State Pension if you continue with the claim but this will require you to be assessed for Limited Capability for Work, this will require an assessment, a Paper Based Review is possible but it is more likely that a telephone assessment will be done and as it is a new claim, it is possible that a face to face one will be required when the current suspension is lifted.

hi so i have applyed for new style esa how do i apply for the old style esa or can i not do this and will that require a face to face accesment as i am unable to attend them
so do i have to send a medical note to doctors .and what about the disability premiums will i be elegible on esa.

Your first post suggests that you are already on Universal Credit so you cannot make a claim for what is now called legacy ESA.

You are already receiving Class 3 NI Credits as part of your UC claim, whilst NS ESA pays Class 1 Credits, if you are unable to meet the Contribution Conditions in the first place then there is limited, if any, value in your pursuing the NS ES claim.

Have you checked whether you do have the required NI Contributions in the Tax Year 2018-19, the DWP don't always get it right.

The Fit Note is required for the DWP to make payment of any ESA you are entitled to but if you are not entitled to payment then it's not really an issue, however, I would maintain one on file to avoid having to deal with further letters that are not actually relevant to your situation.
