Hello,
I am currently on ESA Support Group, legacy benefit.
Will I lose this legacy benefit if my partner moves in. He will be working part time.
I have tried to find out how the Legacy benefits work.
Will I be forced move onto Universal Credit?

Any Contribution Based ESA will not be affected by your partner moving in.

If you receive Income Related ESA then there will be an increase in your weekly amount as you will become entitled to the Couples rate of the Personal Allowance, you must inform the DWP when your partner moves in.

From this will be deducted, after a £10/week disregard, any income that your partner receives £ for £, If this exceeds your ESA(IR) then you will no longer be eligible. If you are receiving Housing Benefit then losing your ESA(IR) will impact on the amount that you are entitled to.

There is a limit on the number of hours that your partner can work, if they are doing 24 or more hours a week then again you will lose your eligibility for ESA(IR).

If you are receiving the Severe Disability Premium which shows as "money because you are severely disabled on the Entitlement Letters, then this will no longer be payable as you won't be living alone unless your partner also received a qualifying benefit.

Your partner moving in will not trigger a transfer to Universal Credit but I would put your information into one of the online benefit calculators, depending on your circumstances you may receive more on Universal Credit.
