Moving to new LA, HB/UC/SDP was created by Rogue_One
Hi,
I currently live with family. I claim ESA (support group) and PIP (daily living standard component.)
I would like to move to a different local authority, where I would live alone.
Ideally, I'd like to avoid having to claim UC. Is this possible? According to various benefits calculators I've used, if I moved house and lived alone I would then be eligible for Severe Disability Premium. I have read that simply being entitled to Severe Disability Premium precludes a UC claim and allows you to remain on legacy benefits.
Many thanks for any help on this matter

First, you need to be receiving what is now called legacy ESA and not New Style ESA which is a Contributory only benefit as the Premiums are only payable with Income Related ESA. You should be receiving the Enhanced Disability Premium for being in the Support Group, it will show as the Disability Income Guarantee on your ESA Letters
Your second issue will be Housing Benefit if you need to claim it. You are correct that the SD Premium bars a claim for UC but you have to be receiving the Premium not just be eligible for it. So if you need to claim UC you will have to move and initially cover the rent yourself, advise the DWP that you are now living alone and eligible for the SD Premium and then when it is in payment, make a claim for HB which you should be able to backdate.

Hi Gordon,
thank you for your response. Yes I am on ESA legacy, apologies for not making that clear.
Just to clarify, when I go through the process you advised upon moving address (SDP claim, waiting for payment, then backdated HB claim), I would remain on ESA (after notifying the DWP about a change of address?)

Yes, the moving does not affect your ESA, it is the claiming HB that would cause a transfer to UC if you are not receiving the Premium.
