Hi I applied for PIP and sent the form back with in the time frame but received a letter to say that they had refused my claim due to the form not being sent back. I called them and was told to resend the form and request a MR
I sent a copy of the form and covering letter but record a letter to this morning to say they’ve looked at th information and no change.
Do I now go to appeal? I haven’t had an assessment or anything. Can I also start a new claim at the same time?

I'm very surprised that the DWP have not accepted your late form, they have been allowing 90 days to return the form instead of the normal 28, when did this all occur?
Have they acknowledged receipt of the replacement copy?
Yes, you can appeal the Decision but be aware, it could be sometime before a hearing is held.
You can make a new claim for PIP, there is no waiting time.

The original form was due back in April. The second form was sent in July when the letter refusing the first time came. They haven’t acknowledged the form as such but they have received it as they make reference to it in the second refusal.
