Hi. I wonder if you might be able to help. I have today had a letter attached to my u.c journal telling me I have been given a backpayment of £213.67 from 9th Aug to 8th Sept 2020, after being awarded lcwra on Friday (I was previously in the lcw group). In Fridays letter, it clearly states "the extra money is awarded from 3 months after the date you first gave us evidence of your health condition or disability, unless an exception applies". I sent the work capability assessment form back in June 2019, but only had my assessment last week. Should they therefore be back dating the extra £213.67 per month from September 2019 (3 months after I first gave evidence)? This is a joint claim with my partner who is self employed on a low wage. Any insight to would be greatly appreciated.

If this was a new claim for UC then your LCWRA award should be backdated to the beginning of the fourth period after you provided the DWP with evidence that you were unfit for work, this would normally be done by your providing a Fit Note.
You say you sent your WCA form back in June of last year but when did you first provide a Fit Note?

Thank you for your reply Gordon. I first sent in fit notes back in Sept 2014. I last sent in a fit note back in 2016 before I had my previous assessment, at which I got denied ESA, but got put in the wrag group at tribunal in May 2017. I moved in with my partner in July 2018 and we started a joint claim for u.c and my award then became LCW. I got sent another work capability assessment form in May 2019 and returned it the following month in June 2019. I have just had my assessment from that form last week & put in the LCWRA group. As the letter I got on Friday stated that I would be paid at the new rate from the 3rd month after I submitted the latest evidence, I thought it means any new award wiuld be back dated to September 2019 (three months after submitting the evidence with my wca form in June 2019).

So this is not a new claim in which case there will be no backdating of the award, the LCWRA applies from the beginning of the period in which the Decision is made.

Thank you for clarifying this Gordon. I feel like their letter was misleading as it makes you believe that the extra money will be backdated to three months from when I last submitted evidence of my health conditions, but that's how these things seem to go.
