Hi
Can anyone tell me if this information is definitely correct.
If you are single claiming irESA and a new partner moves in who does not receive any benefits you don't have to claim UC.
If this is the case I should be able to claim ESA for my new partner who has had to give up work due to her own illness and the DWP can't force you to claim UC.
I don't want to lose half my old benefit because I will have no transitional protection.

No it is not correct, if you were claiming CB ESA then it would be correct.

IR ESA is a means tested benefit and therefore you need to report changes to your circumstances so you keep getting the right amount of Employment and Support Allowance (ESA). So if you have a new partner who moves in, then you need to report a change of circumstances, if not you will be hit with an overpayment and even benefit fraud.

Thanks Gary was just checking this as it does state what I have asked on the migration form on this site
