My grandson has a severe allergy to all nuts he was 6 years old when awarded it .They have now turned him down after 2 years his condition has remained something similar or even worse as he is allergic to airborne nut particles .he carries EpiPen. Do you think they expect an 8 year old to be able to look after himself eg cook meals from scratch making sure ingredients are nut free read all labels on everything he eats .he has taken allergic reaction because his friend was eating a pastry and blew particles around him .do you think I should take this to mandatory reconsideration x

Hi Ann, I would definitely request a copy of the assessor's report in order to understand their logic on why they feel your grandson does not qualify any longer. The answers on this form may throw some light on what they were considering, what evidence they looked at etc. If you feel they have not considered your son’s application fully, then that will be your basis for a mandatory reconsideration. You can send in further evidence at this time to show where you feel the DWP have got it wrong. If you feel you need more assistance after getting the assessment there are loads of people on here that can help you.

Hi Ann Free,
I would agree that obtaining the assessment report would be helpful. In order to achieve DLA, you will need to show that your grandson has substantially more needs than an ordinary child of 8. You mention that an 8 Yr old won't be able to read and properly understand food packets or appropriate food hygiene that pertains to him. You may wish to obtain evidence eg from your grandson's form teacher about generic reading levels/understanding. If your grandson has any learning difficulties it will be important to describe these, as they may also be relevant. It seems likely that supervision and/or physical assistance may be required in the event of your grandson having an allergic reaction. If you wish to make a MR it is important to describe what sort of help or supervision is required, and how often. Also how often are the allergic reactions, and their effect. Are there any other health conditions that affect your grandson. Medical evidence is also important.

Many thanks they told me they dont provide evidence until the appeal stage for dla which I know is wrong will ring again and ask .
