Polyamorous people moving in together and benefits

Hi all,

So, my partner (P) may be buying a house, and has asked me and their other partner (M) to move in with them. (I know, weird to most people, but we're happy this way.) It would be a 3 bedroom house, so we'd each have our own room. We're all disabled.
P is still able to work, and currently makes a lot of money.

I'm disabled and can't work, and am on IR ESA (SG). I'm working on getting PIP and HB back (long story). I know I'd have to switch to UC, but would keep my PIP.

M is extremely disabled, and is on C ESA (assessment phase). She's applying for PIP. She'd also have to switch to UC, but would keep her PIP.

Currently, M lives with P (moved in at the start of Covid, as she needed a carer). I live in a different city, nearby.

If we all moved in together, what on earth would happen wrt P's income/savings? None of us are married, so polygamous marriage rules wouldn't apply. How would we do this? Any ideas?

Hi Waylay

I am not sure what your question is but I will try and answer a few points you have raised

If you move in with your partner then it will affect your IR ESA as IR ESA is means tested and is dependent on household income, the same goes for UC.

As M is in receipt of CB ESA then she would still be able to keep her CB ESA as CB ESA is not means tested and therefore not dependent on household income.

As for P's income or savings, unless P was applying for a means tested benefit then nothing would happen to his income or savings. I would though advise P to sort out a will if buying a property or has savings.

PIP is not a means tested benefit so if eligible would not have an a knock on effect to your living condition. Have a look at our PIP Claim guide for a better understanding of the criteria you will need to meet.

From the information you have given the only person who may be affected by this arrangement is yourself, I would contact a welfare rights organisation who would be able to take all you circumstances into consideration. advicelocal.uk

M and I would be paying rent to P, so if we both wanted to get housing element/benefit, we'd both have to transfer to UC, wouldn't we? The new house will be in a different council (way outside the city).

So given that we'd both be on UC, would we both say that P is our partner?

Hi Waylay

You need to seek advice from a welfare rights specialist in your area before you do anything.

There maybe issues to claim the housing element on UC, you need to contact Shelter for advice on 0808 800 4444 as this is outside the remit of the forum.
