Hi David, CAB called me back today and told me the DWP guidance is correct. That my ESA claim was closed due to the change in circumstances of moving in with my partner and that there's nothing more they can do so the help to claim team have closed my case. I'm waiting to hear back from welfare rights who have been difficult to contact and haven't been responding to email. I'm hoping they can explain things to me.

Hi Blissfulblues

All you can do now is challenge this by an appeal to a social security tribunal. You should be able to get help with this from your local Citizens Advice office . If not I may be able to find a Community Money Advice centre which can assist.

Thanks David. Felt deflated. They even said they never read any of the stuff I forwarded to them that you told me to tell them in this thread. They said all non lead claimants in a couples claim claims are closed when they join on ESA and lose their right due to the change in circumstances and so have to do UC50 when migrated to UC and that this is correct. And that it's happening to loads of people.

Not sure how much I trust CAB guidance so far. I stopped being helped in February when the person I was told was going to be helping me alongside welfare rights officer in local cab didn't and hasn't responded to any updates. And welfare rights officer doesn't answer questions and hadn't replied to an email in around a month. I wish there was someone else who could be helping me with this. I don't feel confident in the help I've received so far.

So I appreciate that this forum is here and that you've been so kind to answer all my questions. And tried to help.
