Going back into work whilst claiming PIP

Going back into work whilst claiming PIP was created by latmarshall
Hi I’m just wondering how likely it is my PIP would be reduced or stopped if I go back into work for a couple of days a week. I currently get both higher rates of PIP for mobility and the daily living component on account of my autism and epilepsy - I had to take it to the tribunal to be awarded this. I also receive the LCWRA component of universal credit. I’m already aware LCWRA component of universal credit will stop but the rate of universal credit whilst working part time is practically the same as universal credit LCWRA group. I really need to get back into some form of work to help keep my mind stimulated. I’m just worried my PIP will be stopped. I’ve always struggled to keep a job for long as I’ve had 20 different ones in the space of 10 years. But I think if I took time to find the correct job and limited my hours I could sustain a job. Any advice or people who have done this that also receive pip? Thanks

In addition I was in full time work when I made the pip claim but was refused by dwp - but by the time I had my tribunal hearing I was out of work and they specifically asked me if I was currently in work.

Hi latmarshall

Some people who have been awarded PIP also work. Whether your PIP would stay at the same rate if you get a job, I can't say. It will very much depend on where you have been awarded points and whether that is impacted by your working. You can expect them to review it as a change of circumstances, once you inform them, if you have a job.

This is what worries me... i think they will try to take all my pip away from me since they initially gave me 0 points overall yet the tribunal awarded me enhanced daily living and enhanced mobility and backdated it to the points way before i was out of work. I just think the DWP will try to use any excuse to take it away from me so they save money even though I can only do certain jobs... and even then I've been unable to sustain them in the long term.

Hi latmarshall

I understand your fears, but there's nothing I can say that will sound reassuring at the moment. The government is looking at how to ease people back to work and allow them to reclaim their benefits from where they were if it doesn't work out - but it is a proposal that isn't in place at the moment. If you go to work - there is a chance that the DWP will assume your health has improved unless you can argue that you need the same support in the workplace.

Thanks for that advice. If it is the case they feel I have miraculously improved so much that it warrants me not scoring enough point to get any pip rate at all - would it be the case that they re-assess me first before removing the benefit or do they have the power to just stop the pip benefit all together without a reassessment?

Hi latmarshall

I can't give you a definitive answer, but I think it will probably depend on what you say. If you say that your condition has improved, but you still have certain needs, they will probably reassess you. If you say that your condition has improved and you intend to go back to work, they are more likely to just stop your PIP. If you want a reassessment because there have been some improvements - they will do so.
