Question re permitted work, NS ESA and UC

For the attention of moderator David:

My son does between 3 and 6 hours supported permitted work under ESA rules and, when he’s eventually migrated to UC, will also get NS ESA and UC LCWRA. I'm aware that there is no supported permitted work under UC but instead a work allowance, but there is still supported permitted work under NS ESA.

I read with interest the thread 'PERMITTED Work on NS ESA & UC LCWRA Work allowance’ but was puzzled by this: you wrote "Are you aware that if you reduce your work hours under UC it is possible to lose all your Transitional Protection?” I cannot understand that even with reading the link to the government paper on transitional protection. How would that affect someone like my son who doesn’t work the same number of hours each week, but he’s never done more than 6 hours work a week and usually only does 4 hours (at minimum wage per hour).

Hi Anneb

As you son does not earn over the UC AET then he will not be affected by the following rule regarding Transitional Protection.
If you are earning above the Administrative Earnings Threshold (AET) and have a sustained drop in earnings to below AET for three consecutive months then you lose all your Transitional Protection permanently.
A nasty rule devised when the Tories were in power !

Thank you David, that is reassuring to know.

Since I'm asking about work when on NS ESA and UC - will I have to report my son’s earnings to both UC and NS ESA ? For his current ESA I have only had to report his earnings on a few occasions when they’ve specifically asked me.

Hi Anneb

There are 2 types of employment as far as UC is concerned-- employed and self employed.
There is no need to worry about employed work as it is reported to UC digitally by the employer under the RTE system
Self employment is different....that's where it gets complicated!

It is employed work my son does so I presume it would be digitally reported to UC by the employer...fingers crossed !
