Hi Onyx123,
Wait for 1 week past the due date, then send an email to the tribunal saying that DWP have not fulfilled their duty by supplying the response, give the dates etc..(This is basically the appeal papers or bundle as is sometimes called- it will consist copies of claim form/s, assessment report, any medical evidence etc you have sent in. Tribunal also get a copy.)
Send the email with the case reference number and also ask for a Direction that DWP should supply their response within 2 weeks, and that failing that the DWP case should be struck out.
Very unlikely that the DWP case will get struck out*, but it makes the Tribunal more proactive.
*Strikeout will mean DWP isn't able to put forward any evidence which could include the assessment report. And could mean they won't be able to take part at a hearing. The Appeal will still go ahead with your evidence alone.
I hope this helps.
