Hi all,
I just become a member and sure it was a good decision!
So, I am concerned that there may be a problem with my PIP decision.
I made claim 1, 18/09/23. Rejection followed. Finally after adjournment, Tribunal awarded 17 month award both enhanced rate components.
The award ran from 18.09.23 to 17.02.25.
This is because I made a new claim on the advice of the judge that adjourned my first hearing scheduled, and immediately adjourned on 18.02.25. My conditions are medically categorised as permanent, incurable and severe.
I now know I made a huge mistake acting on the first judge's advice and by making a new claim on 18.02.25, I created a "closed award" of 17 months from the Tribunal on 12.05.25.
My assessment for second claim was last Friday. On the Monday previous, I called DWP and asked in a few different ways for confirmation that the HP assessor could access and refer to my decision notice and my written statement of reasons. This was confirmed more than once
(I recorded the conversation).
I did the assessment 4 days later. Assessor seemed professional and I didn't make reference to my court documents, partly because I believed she had them anyway and because I didn't want to appear to be boasting. However, as she had not mentioned my Tribunal award from 5 weeks before by the end of the assessment, I then did so.
I read her a full page statement I had written directly quoting the tribunal panel's comments from the 2 documents above. I finished by saying, because my conditions as as previously stated, I therefore expected to awarded PIP on at least the same rate as the award made 5 weeks earlier.
The assessor was dumbfounded. Possibly shocked. She said I don't understand then why they've sent you for a reassessment if this tribunal was only last month.
I could not speak any longer as I was exhausted.
I called DWP today, ordered my PA4. The agent today said HP assessors do not have such documents, and that I was "misinformed."
I said what had occurred was an important issue and needed rectifying, and that if I discovered that the errors have negatively affected my claim, I pursue it further.
That's about it really. I hope no-one else finds themselves in a similar highly stressful scenario.
Amy advice would be hugely appreciated. You feel so isolated in this process.
Kind regards,
Editha

Hi Fy7
I'm sorry you didn't receive an answer to this - it's complicated, and I'm unsure of how to respond, because I don't understand the issues here. I see however, that you have since posted a new post - so I will go to that one.
