Dental charges exemption during ir-ESA to UC migration period

I started managed migration from ir-ESA to 'new-style ESA' + UC at the end of April, & my 1st UC payment was on 30th May. I received an interim ESA payment on 12th May, but I'm not sure of the breakdown...however it was more than my 1st new-style ESA payment (which started on 23rd May).

In this period of transition, I needed emergency dental treatment on 19th May. The dental receptionist prefilled the form for eligibility for free treatment from my previous records, & I forgot to tell them that I was in the middle of managed migration - i was in too much pain to think straight.

I've now received a letter from the NHS Business Services Authority, DECS department, saying that they can't find proof of my ir-ESA award on 19th May.

I have rung the number on the letter, & basically have been told that "As your first UC payment wasn't until 30th May, you were in fact between benefits & therefore you were NOT eligible to receive free dental treatment. You are liable for dental charges of £27.40 AND £100 PENALTY".

Surely this cannot be correct? I'm really upset & EXTREMELY worried!

The advisor said I need to send proof of my eligibility for either ir-ESA or UC for the specific date of 19th May...but I'm so confused by old ir-ESA payments being paid in advance, & new UC payments being paid in arrears

She said that "You're only eligible for free treatment AFTER your 1st UC payment date, even if you were awarded UC in the period beforehand". Apparently it all depends on this 1st UC payment date, regardless of my (unwanted) 'managed migration' from ir-ESA.

They say that I wasn't receiving either ir-ESA or UC on 19th May. In which case, why was my Council Tax reduction not revoked mid-May? I've had letters from my Council (in the same postal delivery as the NHS's DECS letter) stating that there is NO CHANGE to my eligibility, they just amend their records accordingly.

I can appeal, but need 'Proof of Entitlement' which I am struggling to find exactly what I was on at this specific date.

I cannot be the only person affected in this way. Any help & advice would be greatly appreciated!
