In the MR, I also scrutinised the HP assessment which contained factual errors, significant omissions and Misconstructions. I detailed each one asking the DWP to check the HP audio recording that HP told me was being made. I also did my own convert recording and checked each point I disputed before including in MR.
DWP told me HP would have full knowledge of access to my Tribunal documents. That wasn't the case. I have a letter from DWP apologising for misleading me.
I do not expect them to move because they know that my evidence was described by the judge as "cogent, consistent, detailed and credible" more than once. Even so, it's hugely stressful.
Morning. I would put a copy of the Tribunal decision in with your application, and any reasoning given. Phone the Court and ask for the ‘judges notes’ (they only keep them for so long so do that NOW).
Put in any medical evidence from the date of your last award Start date. You need to ‘prove’ your condition is the same or has deteriorated, during the course of your award. They go on the past 3 months, but I always give a history since ‘dot’. Good Luck.
