Severe disability premium was created by Ted Pea
Hi,
I've had a severe disability premium added to my ESA for a number of years, as I get the enhanced daily living rate for PIP.
I don't believe this exists anymore under UC, but I have recently migrated, and I'm continuing to receive it as a transitional protection.
However, my PIP is currently up for review, and I'm braced for getting a reduced award.
ie, I might not get the enhanced rate for daily living.
If this is the case, would I have the severe disability premium automatically removed from my ESA?

Thanks in advance

If you were to stop getting PIP this would have no effect on your Transitional Element (TE). The only things that will end your TE are significant changes of circumstances such as a partner moving in with you (i.e. you have to make a joint claim) or your UC award ends due to capital above £16,000.

It's also worth noting that if someone starts to get Carer's Allowance for looking after you this too would have no effect on your TE even though under the old system (when getting Income Related ESA) it would have stopped you getting the Severe Disability Premium.

Hi Ted Pea

As you have migrated from ESA to UC, PIP does not usually affect your UC claim, there are exceptions.

TP is affected by a change in your circumstances such as a increase in your benefits or if a partner leaves or joins a household.

As we do not have all the facts, we would advise you to seek help from your local Welfare Rights Specialist; you can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies in your area advicelocal.uk
