I feel stupid asking this, but despite my trawling thru as much info as I can , I am still confused…

Do I actually HAVETO go thru the process of migration (filling in all the form), or am I exempt?

I been in the support group of ESA for years, and receive PIP. DWP told me I must reapply for UC, but because of my condition (I have ME/CFS as well as various mental health disabilities), I have over the last few months been really ill with a flare up and incapacitated in bed (due in part to trying to prep for the PIP application.

I’ve got a third extension on the PIP which gives me some time to heal, but also extended the UC a couple of times, and now feel pressure from them to get in - I won’t do coz is tomorrow, and still v ill!

I will have to call them again tomorrow to explain, but if it is at all possible I could be naturally migrated over- how do I tell them this/ show proof of the fact as I’ve already asked.

Soz for lengthy post
Many thnks in advance x

Hi 1rule4them

Welcome to the forum.

You might want to have a look at the following FAQ which explains where everything is; www.benefitsandwork.co.uk/guides-for-claimants/faq/forum.

Don't feel stupid asking questions, as I always say, there is no such thing as a stupid question.

In answer to your question, yes you do have to apply for UC if your receive Income Related ESA and or Housing Benefit. You are not exempt unless you only receive Contribution based ESA in which case you can stay as you are for now.

If you are in receipt of IR ESA and need help in applying for UC, Citizens Advice Help to Claim would be able to calculate exactly what you can expect in your individual circumstances - see page 46 of the managed migration guide www.benefitsandwork.co.uk/?dlp=68fa98bbb107d.
