Hi everyone,
I am on cont based ESA and Pip, i have received a personal pension for the last 5 years, and i have duly advised the DWP every year of the increase i will receive on the 1st May, this year i advised them by phone mid April of my peronal pension increase, so my ESA was reduced in early July, , last week i received a letter from the DWP dated Otober 25, , advising that although i had advised them about my increase mid April 25 this had not been input into their system until the 9th July so i owe them £114!! So i rang them which caused a great deal of anxiety which is one thing i suffer from, after 1.5 hours i get through i explained the situation to the lady who said yes you owe the money!!!, me, but i advised you in April, it is not my fault you didn't input it till July, she confirmed it was on my records i had advised them mid april , she said she would raise a mandatory recon to a benefits officer and they would get back to me within 10 days???, any one else been in this situation, the stress it has caused has been awful thanks DWP, thankfully only on ESA till April when i can get my state pension.

It would be interesting to hear from other Forum members on this subject. Is your ESA called New Style ESA ? It makes a big difference with DWP official errors.

If you have not participated in Managed Migration then your ESA will not be New Style ESA. This means that you don't have to repay the £114 as the overpayment arose because of DWP negligence in other words official error.
If you have an overpayment of any of these benefits, most of the time you cannot be asked to pay it back. You can only be asked to pay the overpayment back if the benefits office can show that you misrepresented something or failed to disclose something which affected your entitlement.
Income Support
Jobseeker's Allowance (JSA) (but not New Style JSA),
Employment and Support Allowance (ESA) (but not New Style ESA),
Personal Independence Payment (PIP)
Disability Living Allowance ( DLA )
