PIP – MM Judgment / Out of Scope – Conflicting DWP refusals

Hi all,

I am looking for help understanding my MM LEAP situation and the DWP position (aka tactics).
Background

• PIP award Jan 2014 – Jan 2018 (went to tribunal)
• PIP award Jan 2018 – May 2022 (did not go to tribunal – I accepted the DM decision)
• Standard Daily Living throughout Jan 2018 – May 2022
• No Enhanced Daily Living awarded during that period
• I was not aware of the MM judgment until 2025
2022 Tribunal (not to be confused for 2022-2026 time period but for MH RJ)
(held November 2022)
• Only covered mobility (MH/RJ)
• Only looked at Question 11
• Awarded 10 points mobility for approx. Jan 2018–Aug 2019
• Did NOT look at Daily Living descriptors
• Did NOT consider MM
• I did not raise MM (because never heard if it)
• Did NOT examine Aug 2019 – May 2022
2024 tribunal
(for years spanning 2022–2026)
• Increased Question 9 from 2 to 4 points (underwent a change in circumstances in 2021)
• Awarded Enhanced Daily Living
• Backdated award to June 2021 only (change in circumstances date)
• Did NOT look at anything prior to that backdate

2025 MM 7057 form

• DWP sent me form PIP.7057MM in June 2025
• Returned on time
• First excuse was that I challenged the 2018-2022 award, which is not true I accepted the case managers decision and didn’t go to tribunal.
• I have since been told by several Leap case managers the form was “sent in error” / I am “out of scope”
• I have also been told the tribunal(s) 2022/2024 would have already applied MM
• Some then change their tune and say they believe I may be correct and that they will call me back, but I never receive the callback. When I phone again, the next case manager often has no awareness of the previous discussions despite looking at the notes, and ask to re-explain my situation from the beginning, and the cycle repeats.
• Each LEAP case manager initially tells me I challenged the 2018–2022 decision, and when I explain I did not, a different explanation is given instead.
• I am told I will receive callbacks, but these do not happen.
• When I call again, I am usually connected with a different case manager, who tells me that someone else within DWP has reviewed it and concluded I am not eligible.

I would appreciate any advice on how to proceed and whether the DWP can refuse an MM review on this basis.
