UC85 Missing Information was created by Darach
Hello,

I have just received a copy of my UC85 after being awarded LCWRA.

I originally applied because of the difficulties I have relating to mental health (autism and a few others). I also have physical health issues but they do not impact me as severely.

I sent in plenty of evidence about my mental health, but during my phone assessment the assessor only wanted to talk about my physical problems. Under all of my mental health conditions the report says "curtailed due to mobility". Does this mean they didn't take into account any of my mental health issues? Or did they have enough evidence about those already and didn't need to ask me anything else?

It is really important to me that the report is accurate because I feel like being awarded for the 'wrong' thing is like lying because it doesn't present the whole picture, which is that I am physically limited but mentally limited even more.

If I have a physically better day I am now scared to e.g. go for a 1 hour walk, because the assessor has written down that I can only normally walk for 20 minutes without a rest. While this is true, one of the issues with my mental health is that I get huge surges of adrenaline that make me move around more than my physical health allows, with horrible fatigue after. Without having my mental health symptoms recorded I am worried that is looks like I am misrepresenting my situation.

Can or should I do anything about this lack of information in my report?

I am also worried that this report will also negatively affect my next PIP review, which is based on mental health, because it looks like my only problems are physical.

Any advice much appreciated.

Hi Darach

You will realise from reading the posts of Forum members that the majority do not think their UC85 report is accurate.
The UC85 is not supposed to be accurate in the way that a hospital consultant's report would be expected to be accurate and for a diagnosis to be the same from two medical clinicians.
The DWP in fact say that the HAAS assessor can come to different conclusions from a hospital consultant because the hospital consultant is not a specialist " in the world of work ".
The UC85 is just the opinion of the HAAS assessor of how the claimant's health affects their suitability for " the world of work " according to the official descriptors. That is why over the years a person will experience differing assessor's reports though their health condition has not changed.
You have been successful in so far as you have been awarded the LCWRA element. This is relevant as most new LCWRA awards after the 6 April next year will be at the much lower payment rate.
So if you were my client in front of me I would advise to desist from complaining. I would also advise as far as future PIP medicals are concerned to make sure you keep all paper evidence and if you get any medical endorsements from clinicians to try and get them in writing so that they can be used as future evidence.

You say that you get a huge surge of adrenaline and can walk for an hour. This is acceptable for those with a varying health condition which means on days with less adrenaline they cannot walk for so long. However if your walking ability were to permanently improve and this was endorsed by your GP then you would need to report it.
