I am enquiring on behalf of my friend who is terminally ill and has had a terminal illness life insurance payout.
This takes her above the £16k capital limit. Presumably her UC will end.
She has been on UC with LCWRA for circa 2 years and was on ir-ESA in SG prior to this. I am assuming she will have NI credits from this that enables her to claim New Style ESA?
I am wondering if she is able to claim for New Style ESA and whether this should be done immediately or if she needs to wait until her UC ends due to savings over £16k.
Also, will she begin her claim at the assessment phase of ESA or will her LCWRA transfer over?
(It is also worth checking whether life insurance payouts are exempt from capital?)
Thanks in advance for your assistance with a particularly sensitive issue.
From the information you have posted, I do not believe your friend will be entitled to claim NS ESA, we would advise you to seek specialist advice from your local Welfare Rights Organisation: advicelocal.uk where they can take all your circumstances into consideration when giving you advice.
