Incredibly, UC has now been reviewing my previous WCA and it decided automatically to give me LCWRA status! Just incredible! I am so happy! You may be due for some backdated payments depending on whether you requested a WCA review yourself or it was imposed by the DWP.

Hi David,

it was imposed by the DWP, I didn't do anything! It totally came out of the blue. I have already received the backdated payment for last month, +£200, last night.

I am extremely grateful. I know the LCWRA is not permanent (and what is?) and so will keep this in mind. Can never take anything for granted. I found your previous advice very useful, e.g. continuing with the self-employment and how the DWP 'likes' me more for that. I get a hunch that you are absolutely correct, I was already doing these things and they seemed to work very well, compared to previous experiences of years ago. Thank you.

the Claimant's Commitment is still the old one, in line with LCW, not LCWRA , for example one of the commitments is 16 hours activity weekly, which I don't agree with, however I am going to accept the Claimant's Commitment today solely to avoid my claim being possibly closed.

I wrote all this in the Journal, i.e. to make it clear that I still expect my Commitments to be modified later to reflect my LCWRA, and that I don't agree to its present state, for example the 16 hours weekly activities.

mmmmh....I think, chances are the DWP made a mistake. In the letter there's written that I am getting the 'limited capability for work and work related activity', but for this month's statement and the previous one, the revised statement have this addition only 'limited capability for work' of £ 158 something.

So either the letter meant LCW and they made a mistake and applied the LCW element instead of the LCWRA, or the reverse, i.e. the statement is correct but the letter is wrong.

In the latter case, it would seem pretty ridiculous, to state in the award letter LCWRA but meaning LCW. But I believe that it's what happened.

Too much beer, I guess :)

These days everybody on UC ( apart from Appointees ) have to have a Claimant Commitment. But if you have LCWRA ( Support Group previously ) then the CC is just a basic one where you only agree to inform the DWP of a change of circs.
