Hi, I am very confused! Please advise if possible!

I have just had a PIP review. I sent in 47 pages of evidence and 13 pages of extra information. All clearly cross-referenced, with a contents sheet. It was a masterpiece...

It arrived at DWP 6th Feb. On 10th Feb I got a text saying a decision had been made. The letter (dated 9th Feb) arrived this morning. I have been reawarded, which is good, but it looks like they haven't read any of the information and have just re-used last time's decision. I actually submitted a lot of data ( from MapMyWalk) and details of how poor my walking is now, since I have developed and been diagnosed with a new condition in the last 18 months which has seriously affected my mobility. I scored 0 points on moving around. My condition fluctuates but most days I need to rest every 50-100m. I think because I manage to go 300-350m with my dog, they've just looked at that. In reality this takes me about 45 minutes, with usually 6 rests on walls or my camping stool, and I'm on the sofa afterwards and can't repeat that.

I rang DWP to get the assessor's report, which was itself torturous because I have to use the Relay app so have to sit there doing nothing but watch the screen for 45 minutes... DWP said there is no assessor's report because I didn't have an assessment appointment in person/phone/video. So I will have no idea on which basis I have scored 0 points for moving around. I scored 10 points for being unable to do familiar journeys. I was hoping to get enhanced mobility so that I could get a wheelchair through the mobility scheme (unlikely to get an NHS powered wheelchair because I can shuffle around indoors, and I can't use a manual chair because of carpal tunnel and hand arthritis).

Do I just write that I disagree, and re-submit that evidence for Mandatory reconsideration?

Will they continue paying my current rates of PIP if it ends up going to tribunal until a tribunal is heard, or does it stop during the waiting time?

Will they stop my award out of spite because I've challenged their decision? I use my PIP to pay two support workers so I can't afford that to happen!

Thank you for any advice you can provide.

Hi Tracy

Unfortunately, since the pandemic, they no longer write reports for paper-based assessments, which is what you had. I believe it puts people at a distinct disadvantage if they want to challenge the decision.

1. You will not be penalised for challenging the decision. The majority of Mandatory Reconsiderations end in failure and the claimant continues to get paid what has already been awarded. (Only 27% are successful, but that doesn't mean you shouldn't try). I have only ever known two people to receive a lower award after an MR, and they were in unusual circumstances. Claimants are much more successful at the Tribunal, with about 67% succeeding.

2. In terms of your moving around, I am not surprised that you were awarded zero, and yes, that's because you told them you could walk 350 metres, and they ignored anything else you told them. You can absolutely say that you disagree and say that the assessor missed or ignored information about the pain you are in, the slowness of your mobility, the exhaustion you experience from walking, etc etc.
