I am claiming UC LCWRA and PIP as I have Me/CFS.
The housing element is for the service charge on my flat. I’m entitled to claim for it except for the portion of buildings insurance.
My landlord sets the budget and charges in April. The following year or more later, they produce the final/actual accounts.
The landlord will only produce these details for the whole estate, and I have to calculate the apportion from them.
Recently the final accounts showed that the landlord had higher income than anticipated from service charges. The final accounts state that any excess is paid to the sinking fund, not refunded


I have paid my landlord at the original rate, on submitting the final accounts UC calculated my apportionment based on the inflated service charges and reduced my entitlement, irrespective of the actual bill and excess not being refunded to me.

Is this in line with their policy, or not? It seems unfair to me, but I genuinely can’t find any info on it.

(The buildings insurance came in a bit cheaper than expected, so I could have been underpaid but now my whole entitlement has significantly dropped due to the service charges calculation changing)

Hi Pippyp

We would need to know how much you actually paid over the year. How much you were overcharged by the landlord. How much you were refunded or have a right in law to be refunded by the landlord.
The DWP are not responsible for a charge which can be recovered by legal action.
