Hi All
I recently had a query from my clmt, i recently became his appointee.
He just noticed, after 1yr+ on UC , that DWP were deducting £100+ each month from his UC ent. I explained that UC stm showed deduction against his declared savings. He was adamant that he didn't have that amount of money. At the same time he couldn't understand where this money went if he did have it.
I was worried ... where did this savings figure come from ? what was the correct amt if any? where did his money go ? etc.
I talked him through the process of looking back on his back stms. He didn't know how to access historical stms. Eventually we got there and learnt it was all legit spending ... cost o living and medical expenses.
Through this process i discovered he had other accts and the bal potentially means he isn't entitled to UC and likely result in a massive DWP overpayment. i have explained this to him.
I am now working up the courage to Inform DWP, but scared and uncertain of the outcome. He defo didn't act fraudulently he has SMI , ABI , ASD , epilepsy , heart defect and MH issues.
I asked how he applied for UC and was informed that he went in person to jobcentre appt with brother to support him. However the agent wouldn't allow his brother to sit and support him. He was previously on DLA indef and IS
I also know that his mother/main carer died 2024. He recvd inheritance. He was not aware that this needed to be declared , bec in his understanding this was 'inheritance' Not 'Income'. He has issues understanding terms and concepts we take for granted.
i've recently showed him the UCJ , it seems he's never logged in. i'm not surprised tbh bec he doesn't even use the NHS app.
I believe DWP will recoup UC paid to date. i'm more concerned about any other action taken against him. Surely he can be granted some consideration given his disability?
How should i report it ? what can i expect ? should i seek out legal advice in this situation ?

Overpayments
If there is an overpayment on a Universal Credit claim where the claimant has a
PAB or CAB, it may be recoverable from the PAB or CAB and/or the claimant.

How did you become an Appointee? Are you a relation ?
