Hi, I was recently awarded enhanced daily living with a review in 5yrs, which takes me to pension age. I have OA in both knees and both hands. WCA has declared me fit for work. Ive requested a written explanation of decision to go forward with an MR. I do feel I should at least have got LCW, although the condition and therefore challenges wont change as its degenerative, as I score 15 points across two questions easily, and arguably LCWRA. Im doing my own because I was refused ADP in January, and advocate done it on my behalf, and now its going to tribunal. I got 6pts. I done a second application myself alongside the appeal , which has just been awarded with 12points for basically the same issues as the first one. I will worry about the tribunal nearer the time, in the meantime I need to challenge UC LCWRA. Any advice? please and thank you.

Hi Trustdaisy
To challenge as you say the conclusion of the WCA you will need to request first a Mandatory Reconsideration. You will find instruction on how to do this in the following BenefitsandWork guide :-
Employment and Support Allowance and Universal Credit
Mandatory Reconsiderations and Appeals
www.benefitsandwork.co.uk/?dlp=6a41112655d28
Have you requested the UC85 Assessor's report?
