Good evening. I am new here. Thank you in advance for replying my how to question.
I am 68 years old. Have been in daily living standard since 2019
I was awarded pip with 11 points
I had a review in 20222
I turned 66 and was informed I woll stay in my award .
I have subsequently developed nerve damage. In Boty hands after two failed surgeries on both elbows. I have developed motor issues especially fine motor and chronic pain on Thursday at the specialist he started me pregabalin for nerve pain and says it will not be possible to operate on my arms anymore.
I can accept that.
Whilst waiting I phone DWPfor change in circumstances form and have got it now to be completed with the help pf the organisation that helped ne with my initial application. They are helping me.
I took all my paperwork with me when we went through the letters we had one dated in 2025 April.
It said that I do.not fit thr criteria for the MM Judgement adjustment
The advisor also looked at the 2022 review and it clearly states tgey looked at the claim and think I do not need helo but rather prompting,
This is despite the fact that is was written that I get help from friends . It also stated in the review of 2022 that I need helped especially after an assault in the arena I live, unprovoked homophic attack and that I need help from friend all the time
The advisor feels that a mistake was made from the first application with description 9 . What he say is that the decision maker coukd have misinterpreted the description and said it was prompting rather then support which clearly makes it clear that I have support from friends
He sats we can ask for a review, I think it is called a late review because of tge letter dated April 2025.
I have submitted a second and separate review. For the hand nerve issue.
The question I have is do we proceed to challenge the MM Judgement based on the 2022 decision which was before the Judgement and given that they wrote in 2025 that after the administrative review I do not qualify.
The second question is how do I separate the two. One for my hands and the other fir the Judgement.
The advisor felt that the success of the.hand will put me in the enhanced category given.the fact I only require I more point. But he did say do not raise your hopes The DWP use very strict parameters.
On the MM JUDGEMENT. He felt it might be worth it since I believe that the interpretation from DWP has always made me feel it was wrong fr 2019
However at the time it was decided it is better to accept their decision since I got an award that made a big difference to my life and for that I am grateful.
At the time I was nit aware of the MM Judgement until I received the letter which I filed away.
Has anyone had a similar experience to mine. My award was mainly based on my mental illnes which persists.

Welcome to the forum.
You ask how you can separate the issues. You already have.
1. Change of circumstances (you already have the form)
2. Challenging the review of the MM Judgement.
1. You apply for your change of circumstances, emphasising the limitations you now have, which the consultant has confirmed cannot be improved by surgery, and he has categorically said that no operations will be possible. You can also say that you will need increased help from friends, which has been an ongoing issue since your original application. There is no need to say anything about the prompting, because you are telling them that your condition has got worse (which is true). If you want to put in a final sentence to say you are challenging the MM judgment, you can - but don't labour the point here because the decision maker for your change of circumstances will not be the same for the MM judgment review.
2. Challenging the review. You write as the advisor said and challenge the MM judgment. We have had at least two members who reported being turned down, then challenged that decision a couple of years later, and were successful, receiving a back payment. Will you be successful? I don't know, but you have nothing to lose by asking them to look at it again. Yes, I would challenge the 2022 decision.
