Assessment refused as claimant not present with appointee was created by Nicola
Do we have any information as to why assessors are refusing to proceed with pip assessments with just the appointee? All the legislation states that if a claimant has an appointee they don't have to take part themselves. Each person I am appointee for has had a different experience. Claimants are feeling forced and bullied into speaking. Some physically are unable. Some are in special schools etc. What's going on?

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Nicola
I have not seen the legislation you refer to " All the legislation states that if a claimant has an appointee they don't have to take part themselves".
Please would you give further details for PIP.

There is guidance to the Healthcare Professional in Part 1 of the Pip Assessment Guide on how to approach consultations where a claimant has an appointee. A consultation can take place with the appointee only but there are specific circumstances that must be satisfied before this can happen. It doesn't apply in every case where there is an appointee.
