Lost esa form has kead to knighmare was created by helchis
hi i lost my esa form and letter from atos with date it had to be returned by.got new esa form and my partner phoned dwp to check date the esa form had to be back by as we had no letter was told had two weeks to return.i panicked and we searched everywhere and managed to find letter from atos with date on.my partner phoned back and was told to stick to date on letter as that gives me longer and that was the date originally given.if dwp do stick to the two weeks and stop my IB would my letter from atos with date on saying when the form has to be back by mean they would have to reinstate my ib and give me until the date on letter.

Unless you have written confirmation from the DWP with regard to this new date, you should complete and return the ESA50 by the date on the original ATOS letter.

hi gordon thanks for reply ,what if i do get it in confirmation.i wouldnt get it in confirmation until next week if i do leaving me days to fill in.could i phone dwp and say i have atos letter giving me longer to fill esa form in.its longer by 3 weeks the atos letter

You have a statutary right to have six weeks to complete and return the ESA50.
Assuming my dates above are correct, I would suggest you write to your local JCP, say you have now found the missing letter and will be returning your ESA50 to the dates originally given to you to do so and that if they have a problem with you doing so, to contact you by return of post, otherwise you will assume that this is OK.

hi gordon you are correct should i write to office that deals with my benefit or my local jcp as they are different
