just an update on my appeal procedure i have recieved the submission from dwp to tribunal service and from reading the guides of advice on here i have found a load of flaws in it an example of no name or national insurance numbers on emp reports pages the emp contridicting himself on numerous occasions and the decison maker has not taken into account my own account of disabilities or that of my gp but has relied on an old emp report that had beensuccesfully overturned appeal stage back in 2008 and the latest emp report that isnt even filled in properly it is so frustrating that i have to wait until i get a date for appeal which will take ages when in the mean time i have had my dla and income support stopped whilst i wait for a chance to put my side of the story to the tribunal it is just so unfair but it has made me more determined to suceed my case
You have my sympathy on this. I was a DLA Tribunal Member for over 10 years, but gave it up after I reached State Retirement Age in 1995, as the tax man aka HMRC were taking virtually all the fees I was paid for sitting on DLA Tribunals.
At that time, the average wait for a DLA Tribunal was around 4-6 weeks. Most appellants these days have to wait 4-6 months for a hearing because the Tribunals Service is bogged down with IB/ESA appeals with no sign of improvement
