Hi Andrew, do you have the paperwork?

I seem to remember that the decision is 'upheld' from the day of the work capability assessment.

ie; the HCP found you fit on that day, therefore, you are not eligable from that day.

Andrew - It is the date on the letter from the Decision Maker telling you that your claim has failed.

Rachel - It is not the date of the WCA, whilst some may argue as to who actually makes the Decision, officially it is the DWP Decision Maker, the ATOS "doctor" merely makes a medical recommendation.
