dreaded April looming was created by srthomas
Hi
I was wondering if there is anything I could do against this decision? On Saturday I received a phone call to tell me that as from April my benefit would be stopped, I’m on E.A.S on the workgroup I have been on this for the last 2yrs because of the new regulation this is why my money will be stopped, I receive a private pension and my wife is in full time employment so I will not get anything, but can I appeal or can I claim Job seekers allowance or anything else? It does annoy me I have worked for the last 36yrs paying into N.I. and now I need it, they stop me from having it.
Thanks Steve

Hi Steve
I'm afraid the termination of contribution-based ESA after a year is not appealable because it will be passed into law and therefore the DWP do not have any discretion.
Regards
Derek

I wonder what will happen to those of us who having renewed at the one year mark (in my case November) but are still awaiting a medical? I am currently 16 months into ESA (C)wrag, sent renewal off but have not heard anymore since,in a previouse thread i mentioned the contact i have had with atos and the dwp. Even though they have not sent me for a medical or come to a decision on my renewal can they stop my claim from April? I assume if they do but I am then put into the support group that my payments will restart? If they do take the award away am I able to re apply after a certain amount of time or have I now used up all of my "stamp".I have not had any contact from them about my claim stopping in April yet. I just wish that I had already had my medical after 13 weeks but the back log ib to esa has held everything up.
any thoughts would be very helpful
kind regards

I too am on ESA WRAG Group and my money will cease in November this year. However, I am in the midst of an apeal to be placed in the support group. Hopefully this will eleviate the money problem as I understand it if you get into the Support group, even though you are Contribution based, you should still get the ESA after the alloted 1 year. I do not have a pension, my husband who is my carer does work and gets below £12.000 pr annum, however if I fail to get into the support group my money will cease and will not be able to get anything else. I see that DLA will be the next hurdle and will probably lose that to. If this happens our income willdrop by more than £10.000 per annum, with no recourse of help or support. I too have paid all my contributions and continue to do so, for what!!!!,it makes me rather angry.

I have just looked at a link from another post that gives examples of how it will work under the new ruling.
