dla atos stop my childs current claim?

hi

my daughter is type1 diabetic,she has to have her blood glucose levels tested between 6 and 10 times a day and be checked visually every 20 mins. she also has to have
her blood glucose level tested once during the night at 0130 and visually tested 3 times a night.if she doesn't have her blood tested and the visual checks she can
have danegerous hypo attacks which i have to treat with lucozade-sometimes with great difficulty she spits it out! if she is unconcious (she has severe convulsions)i have to treat her with the paramedic drug glucagon which i have to inject.she also has high blood glucose levels.these have to be corrected with extra insulin injections

my daughter will be 16 in april, she has dla for 3 years (and to run for another 3 years from now) but atos wants to review all dla cases of people of working age in april. nothing has changed since she was last given dla, does anyone think atos will stop her dla given that her condition has gone worse since dla last awarded?

beacause i have to test and check her so often (i spend much more than 35 hours a week looking after her that i could be entitled to carers allowance? i get more than
£100 per week (about £115 esa and £55 from a works pension) but is this classed as earnings or is it different if your on benefits? she is on middle rate care (i think) she gets about £209 per month

one last thing can i claim carers allowance now even though she's under 16?

I assume you are referring to the implementation of PIP which begins next year. Please have a look at the Spotlight article at the top of the forum, which has all the latest information on PIP and the changeover.

With regard to you benefits, as she receives MRC you are entitled to claim Carers Allowance for her, however, you should get face to face advice before doing so, to understand what, if any, impact claiming CA will have to your finances. See

hi Gordon, thanks for the advice, i have a few questions:

i get dla as well, will i receive it until oct 2013?

will this support group publish the new entitlement critrea under the freedom of information act? so that we can have the best possible chance of 1) getting PIP and 2)
recieving the same amount of money as we now get on dla?

Everybody currently receiving DLA will continue to do so until they are transfered to PIP, if your DLA award finishes before you are transferred to PIP then you will able to renew your claim for DLA in the normal way.

The criteria for PIP are still under discussion and there have been no announcements with regard to the rates for PIP. I am not aware of any transitional protection with regard the transfer, this does not mean that none is planned.

I expect B&W to produce claim guides for PIP as soon as practical after the details of the benefit are finalised.
