Hi Guys I'm so sorry to post but at my wits end, I have been on IB DLA LC HM for past 10 years,

I have osteo arthritis, Sacrol iliitis, sacro. Which are debilitating mobility condition I have read forums and can't stop crying.

Today I received two letters one putting me in WRAG ESA and the other increasing my Care component of DLA to middle and I've lost my HRM.

I just don't know what to do my GP is very supportive but hasn't been asked for any letters I don't know if my consultant has.

My condition has worsened and my mobility has reduced dramatically.

I have a Motability car with a named driver as I am unable to drive, so I have to hand it back I feel my life is over as I can't use public transport and can't afford cabs everywhere.

In My DM letter it states

I can walk over 200m abnormal speed in a normal manner,
I shuffle as my back is in so much pain I walk abnormally slow and stoop slightly.

It says I have musculoskeletal problems,it states I have full function of lower limbs which I suppose is right as it is mainly my hips lower back and sterno clavicular joints. Bending is slightly reduced I cannot bend and I may experience some pain I am on 2 types of controlled drugs and anti inflamatories and I'm still in severe pain I don't sleep and am on muscle relaxants as i have severe muscle spasms.

They suggest I can walk over 200m before the onset of severe discomfort I am never pain free.

Please help some people suggest I ask for a review of decision whilst others say appeal what should I do. Do I go CAB or a solicitor I am at wits end please help.

Hi Lm,

I am really sorry to hear of your problems.

Can I take it that you have just gone through the migration from IB to ESA, and had a review of your DLA awards?

Hi Lm,

As ESA and DLA are totally different allowances, with different qualifying criteria, e.g. for Mobilty Component of DLA it is a walking test, for ESA it is a "mobilising test" which inludes the use of a manual wheelchair unaided.

If you are not happy with your ESA award and your DLA award you will have to appeal the two decisions within one month of the date of the award letters, see :

On appealing you will receive an automatic reconsideration of the award/s from a different DWP Decision Maker to the one that made the original decision/s.

If the decision/s are not changed in your favour at that stage, your appeal/s will automatically be sent forward to The Appeals Tribunal Service.

Hi bro 58,

Thankyou for your quick reply i just need someone to guide me

Yes I have recently migrated from IB to ESA, when I phoned over ESA award over points she wounding tell me all she said was I had more than enough (I felt she was thinning you should count yourself lucky.

On the bottom of my DLA decision letter they said the decision had been made on

My claim form
My ESA examination
My DLA examinition

I am trying to understand the differences in mobility and mobilising.

I can't believe this decision I am a retired nursing sister and am fully aware of my condition, however the doctor examining me hadn't heard of my condition and didn't know half of the tablets I was on.

Do you advise asking for ESA and DLA questionnaires or just go to appeal?

I will go and see GP to get further evidence ASAP but unfortunately can't see consultant for a few months.

I just can't cope with this pressure but thank you for being there.

Dear Bro 58,

I hadn't considered appealing ESA as i was lead to believe I was lucky getting WRAG group I will find it difficult going to interviews, however now I've lost my HRM I'm not sure how i'll get there now.

What happens with car do they just take it, have you any experience with this problem.

I am so glad someone is listening.

Motability are typically recovering cars within four weeks of the claimant losing their award.
